Divorce and a Czech apartment in 2026: sell or buy out
One wants to sell, the other wants to stay, and the bank still wants both borrowers. Separate SJM, title, loan and housing before choosing a sale or buyout.

A divorce decree does not by itself price the apartment, remove a borrower from the mortgage, decide who may occupy the home or tell escrow where to send the balance. Before an advert or reservation agreement, identify the present legal state and choose one executable route. A buyer should not be asked to finance an unresolved dispute.
Do not infer ownership from one name on a screen
Obtain a current cadastral extract and the acquisition document. Then check the acquisition date, source of funds, inheritance or gift, any marital-property agreement and later court decisions. Under the statutory Czech regime, property acquired during marriage is broadly part of the spouses’ community property, subject to important exceptions. A register display, mortgage statement and divorce petition answer different questions.
- SJM shown or legally applicable: treat a sale as a non-routine community-property decision requiring both spouses to act or valid consent.
- Sole property: still check protection of the family home, the spouse’s housing right and any contribution or settlement claim.
- Equal or unequal shares: each registered co-owner controls a share, while sale of the entire apartment requires an executable transfer from all required owners. Compare a joint sale, buyout, share sale and court route in the co-owned property exit guide.
- Unsettled former SJM: do not describe it casually as “half mine” until the post-divorce legal state and deadline are checked.
During marriage, selling the flat is not an everyday matter
The public-administration guidance says spouses act together in non-routine matters concerning SJM, or one acts with the other’s consent. If required consent is missing, the other spouse may invoke invalidity. The guidance also describes a possible court replacement of consent where refusal lacks a serious reason and conflicts with the interests of the spouses, family or household. That is a litigation question, not permission for an agent or buyer to treat silence as agreement.
Sole title can still be a protected family home
“The flat is in my name” is not always enough. If it is the family household, Czech family-home protections may restrict a disposal incompatible with the family’s housing without the other spouse’s consent. Verify whether the household still exists, what housing right the other spouse has, and whether any divorce or protection order changes occupation. Do not promise vacant possession while that question is unresolved.
After divorce, start the settlement clock
Official guidance says former SJM must be settled after it ends. A settlement concerning real estate requires written form, and settlement of debts affects the former spouses between themselves without prejudicing a third-party creditor. If no agreement is reached and no court application is filed within three years, statutory consequences apply; for real estate, the former spouses generally move into equal co-ownership. Record the date the divorce became final and obtain legal advice well before that deadline.
A private spreadsheet saying “you keep the flat and loan” is not the same as a registrable property settlement and does not release the other borrower. Align the signed settlement, cadastral filing and lender approval as separate deliverables.
“We each get half” is not a complete calculation
Equal shares are the statutory starting point for judicial settlement, not permission to divide today’s advert price by two. The settlement can also account for what was paid from one spouse’s separate property into common property, what common property paid into one spouse’s separate property, care of the family and children, acquisition and maintenance contributions and other case-specific factors. Post-divorce mortgage payments may also need to be accounted for; the Supreme Court has rejected treating them as irrelevant merely because the payer later receives the property.
Compare three exits on the same numbers
- Sell to a third party: agree price governance, repay secured debt, transfer title and divide the remaining proceeds under written escrow instructions.
- One person keeps the flat: establish value, settlement amount and finance; complete the title transfer and lender-approved release or replacement of the other borrower.
- Temporary co-ownership: use only with written rules for occupation, instalments, services, repairs, rent, sale trigger, valuation and default. It postpones rather than resolves the exit.
Compare the routes on the same dated value and debt statement. A buyout can fail because the retaining spouse cannot refinance even though both agree on value. A third-party sale can fail because one spouse will not approve a buyer, access or handover. Test execution before selecting the attractive arithmetic.
If one spouse refuses, identify what the court would actually decide
Refusing an agent, an asking price or a particular buyer is not itself a completed sale. Depending on whether SJM still exists or equal shares have already arisen, the relevant route may be replacement of consent, judicial SJM settlement, or cancellation and settlement of co-ownership. The Supreme Court confirmed in 2024 that a court settling SJM can in suitable cases order sale of a valuable asset and division of the proceeds, including where neither spouse can fund a buyout and continuing co-ownership is unrealistic. That does not let a broker bind the unwilling spouse to a private reservation while the dispute remains unresolved.
Create a two-person sale protocol before instructing an agent
- Who selects the agent, photographer, lawyer and escrow provider?
- What evidence sets the asking range and the minimum acceptable net outcome?
- Who approves advert facts, price changes, viewing access and replies to offers?
- How quickly must each person respond, and what happens if the deadline is missed?
- Which information may be shared with buyers, and which family details remain private?
- Who keeps the property safe, insured, heated and paid for until handover?
Ask for one shared offer table: amount, financing, deposit, conditions, requested contents, target dates and net proceeds. Do not run separate secret negotiations through different agents. The mortgage agreement survives your private agreement
Ask the lender for a dated payoff statement, release conditions and the requirements for removing or replacing a borrower. Until the bank signs an effective change, assume every existing borrower remains exposed according to the loan documents. Divorce, a settlement agreement and a new cadastral owner do not independently rewrite the lender’s claim.
- Third-party sale: map the buyer’s funds to the lender, escrow and sellers and condition release on title and lien milestones.
- Buyout: obtain the bank’s affordability and document approval before promising a payout date. Coordinate refinancing, the settlement payment, title filing and release of the departing borrower; avoid an uncontrolled “transfer first, refinance later” gap.
- Payment history: record post-separation instalments without assuming they automatically change title or the buyer-facing price.

Build an escrow waterfall, not one vague split
Decide whether commission, legal work, preparation, utilities, post-separation mortgage payments and a tax reserve are common sale costs or personal claims. If a disputed adjustment cannot be resolved, do not let an agent improvise. Use a lawyer-drafted retention or settle it outside the buyer’s transaction. Children affect the housing plan, not the cadastral arithmetic
A child living with one parent does not automatically transfer ownership, create a larger cadastral share or release either borrower. But children’s housing needs can matter when a court decides post-divorce occupation and housing protection. For a former family home owned in SJM, the Supreme Court says the unresolved housing question belongs with the SJM settlement; the court can address who must leave and any housing protection according to the circumstances. Keep the child-care decision, ownership settlement, loan and practical moving plan as four connected but separate files.
Occupation and handover need their own agreement
Title, debt and the right to occupy are not interchangeable. Record who lives in the flat, who holds every key, when viewings may occur, what remains in the property and the latest vacant-handover date. Identify tenants or other users and do not describe their rights as ended merely because the spouses agreed to sell.
Where children, threatened homelessness, coercion or domestic violence are involved, ordinary sale coordination is not an adequate safety plan. Separate contact and access arrangements, use independent legal support and follow any protective court or police measures before scheduling viewings.
Do not sign reservation until the execution file is ready
- Current cadastral extract, acquisition document and all later marital-property or court documents.
- Final divorce judgment and proof of finality where relevant; settlement status and three-year deadline.
- Identity, civil-status changes and verified powers of attorney for every required signer.
- Bank payoff statement, lien-release conditions and approval for any borrower change.
- Written occupancy, access, contents and handover plan.
- Agreed price authority, cost allocation, escrow waterfall and destination accounts.
ČÚZK filing guidance requires all persons whose registered rights arise, change or end to be identified as proceeding participants, although an application may be submitted by all or only some participants. Do not confuse “who may deliver the filing” with “whose transfer consent and signature the underlying documents require”.
Check tax person by person and route by route
A third-party sale and a transfer between former spouses are not automatically the same tax event. Acquisition dates, business-property history, each person’s housing use and the legal character of the settlement matter. A practical sequence for a cooperative sale
- Freeze unilateral promises and collect the four maps.
- Get a neutral price range, bank statement and net-proceeds scenarios.
- Choose third-party sale, buyout or temporary co-ownership.
- Have family/property counsel and the lender validate the route.
- Sign the internal sale protocol and appoint transaction providers.
- Launch only when access, offer authority, signatures and payout are executable.
- Use one reservation-to-escrow-to-cadastre-to-handover timeline.
- Close the title, loan, money, tax and occupation files separately.
