Tax on selling a Czech flat in 2026: exemptions
Do not multiply the sale price by 15%. First test residence, acquisition date, inheritance and housing use, then separate two easily confused notification duties.

This guide is about personal income tax on a sale—not the annual Czech immovable-property tax, and not the abolished property-acquisition tax. For an individual seller, the first question is whether the income is exempt. Only if no exemption applies do you build the §10 income and expense file. The sale price is not automatically the tax base, and a “15% tax” headline is not a decision tree.
Branch 1: did you live there for the two years before sale?
Section 4(1)(a) exempts income from selling a qualifying apartment when the seller had a residence there for at least two years immediately before sale. The Act defines bydliště as a place where the taxpayer has a permanent home in circumstances showing an intention to stay there permanently. That is not the same question as the registered permanent-address entry. Treat the entry as evidence, not an automatic pass or fail.
Preserve a timeline and evidence such as utilities, correspondence, insurance, household and family facts. For a sale from the joint marital estate, one spouse satisfying the residence condition can be sufficient, provided the statutory business-property restriction is also met. Unrelated co-owners test their own shares and facts separately.
Branch 2: if not, has the ownership time test passed?
- For real property acquired by 31 December 2020, the older five-year time test generally applies.
- For real property acquired from 1 January 2021, the general time test is ten years.
- Use the legal acquisition and sale events for the particular transaction, not only the year printed on an advert or the date you moved in.
- Business-property inclusion and an agreement for a future sale made inside the restricted period can prevent the simple rule from working.
The acquisition-date split is why two neighbours selling in the same year may have different results. Do not replace it with “property sales are tax-free after five years” or “always after ten years”.
Branch 3: can your own housing need create the exemption?
If you lived in the home for less than two years immediately before sale, the income can still be exempt to the extent the proceeds are used for a qualifying own housing need. A related route applies to certain property acquired from 2021 that fails the ten-year test. The statutory definition covers a closed set of housing uses. They include qualifying construction or alteration; purchase of a qualifying house, unit or land; certain cooperative housing payments; maintenance or alteration of a qualifying home; specified marital-estate or co-heir settlement; and repayment of a loan used for those needs. An investment, a child’s home or an informal transfer to a relative is not automatically your own housing need.
- The money must be used by the end of the tax year immediately following the year in which it was received.
- Qualifying housing expenditure from the immediately preceding tax year can also count under the current rule.
- If only part of the proceeds is used for the qualifying need, only that part is exempt under this route.
- You must notify the tax authority that the sale proceeds were obtained by the applicable income-tax return deadline for the receipt year.
The Act works with the funds obtained from the sale. Do not quietly replace that amount with “cash left after repaying the mortgage”. Repayment of an earlier housing loan can itself be a qualifying housing use only when the loan and original use meet §4b. Reconcile the gross receipts, escrow movements, lender payoff and claimed housing use before relying on a full exemption.
Branch 4: inherited apartment
For an apartment inherited from a direct-line relative or spouse, the deceased owner’s proven ownership period can shorten the applicable time test. This is not a universal rule for every inheritance relationship. Keep the final inheritance decision, acquisition records for both owners and evidence of the relationship. Check whether the residence or own- housing route is independently available as well.
A gift is different. Section 4(1)(b) expressly carries over the deceased’s ownership period for inheritance from a direct-line relative or spouse; it does not give the same general carryover for a gifted apartment. Establish the recipient’s own acquisition date and the valuation evidence rather than importing the donor’s timeline.
Two notification rules that sound similar but are not
- General notice for exempt income above CZK 5 million: Financial Administration guidance excludes qualifying exempt sales of Czech real property recorded in the Czech cadastre from this general §38v notice.
- Notice when relying on use for your own housing need: this is a separate condition of that exemption route and remains time-critical even though the cadastral sale may be excluded from the general over-five-million notice.
Do not conclude “the cadastre reports it, so I never notify anything”. First identify which exemption you use. Foreign property, cooperative interests, non-standard units and other income can also fall outside the cadastral exception and need separate review.
Renting, business property and joint marital estate are different tests
The Act defines business property as property recorded in accounts or tax records. Merely renting an apartment does not by itself prove that it was business property, although rental use affects the expense calculation and the records you need. For taxable §10 income from the joint marital estate, the income is taxed by one spouse—not automatically half by each. If the asset was business property of one spouse, the statutory assignment follows that spouse.
If no exemption applies, build the taxable file
A non-exempt sale is generally handled as other income under §10 for a private individual, subject to the actual facts. The taxable result is not automatically the gross purchase price. Establish the received income and the allowable, documented acquisition and related expenses under the current rules. Section 10(5) includes the demonstrable acquisition price (or the statutory valuation at acquisition for a gratuitously acquired asset), technical improvements, repair and maintenance, and other expenses connected with the sale, excluding personal consumption and the value of the seller’s own labour. Income-tax rates apply to the relevant parts of the person’s total tax base, not as one percentage stamped on the apartment price.
- Acquisition contract, inheritance or gift documents and the legally relevant value or acquisition cost.
- Invoices and payment evidence for improvements and transaction expenses proposed as deductions.
- Sale contract, amendments, escrow statements and dates each price instalment was received.
- Mortgage payoff records kept separately: repaying loan principal is not automatically the same as a deductible acquisition expense.
- A reconciliation prepared before spending the proceeds, then reviewed against the current return form and guidance.
Section 10(4) also limits the result by income type: when expenses for that type exceed the income, the excess is disregarded. Do not assume a loss on this sale can reduce salary, rental or business income. Instalments and advance payments need year-by-year handling.
Six common files and the question each must answer
- Bought in 2019, investment apartment, sold in 2026: verify the older five-year time test and business-property exceptions.
- Bought in 2022, rented out, sold in 2026: the ten-year test is not met. Renting alone is not business-property inclusion; test the actual records, own-housing use and §10 file.
- Actually lived there for 30 months immediately before sale: build evidence for the residence exemption.
- Lived there for 15 months and will buy a new home next year: test the qualifying use, amount, spending window and early notification deadline.
- Inherited from a parent who owned it for many years: prove the relationship and both ownership periods before applying the inherited-time rule.
- Exempt Czech-cadastre sale above CZK 5 million: distinguish the general-notice exception from any own-housing-use notification.
When this private-seller guide is not enough
Stop and obtain transaction-specific Czech tax advice if the seller develops or repeatedly trades property, is acting as a taxable person, sells a new or substantially changed building, has cross-border tax residence, sells through a company, or mixes the apartment with business property. Those facts can change the income category or add VAT and treaty questions that this private-sale decision tree does not answer.
Put tax into the transaction before accepting an offer
