Got a rental termination notice in Czechia? What to do now

Do not start with packing. First identify what you received, preserve the delivery date, and check the reason, form, notice period, and two-month court deadline.

A message saying “you need to move out” does not answer the questions that matter. Is it a notice, a proposed agreement, or simply the end of a fixed term? Was it delivered correctly? Does the landlord state a lawful, specific reason? Your first job is not to argue or pack. It is to identify the document and protect the dates and evidence.

First identify what you received

  • End of a fixed-term tenancy — a contract can end on its agreed date without the landlord giving a termination notice. Check the term and any renewal clause before applying notice rules.
  • Agreement to end the tenancy — this is a proposal. It only works if you freely agree and sign it. It is not the same as a unilateral notice.
  • Termination of a sublease — if your contracting party is a tenant rather than the owner, do not apply this guide’s special two-month route. Use the sublease contract and main-lease checks.
  • Termination notice from the landlord — the landlord can end a residential tenancy only for reasons allowed by law and must meet special content and delivery requirements.
  • An informal message or threat — take it seriously, but do not treat a phone call, chat message, or ordinary unsigned email as proof that the tenancy has already lawfully ended.

Five checks for a landlord’s notice

  • Written form and provable delivery. Preserve the delivery evidence because deadlines run from receipt.
  • A specific reason. A bare reference to a section of the Civil Code is not enough; the notice should describe what allegedly happened.
  • A lawful reason. A lease cannot invent new landlord termination grounds that reduce a tenant’s statutory protection.
  • Information about objections and court review. The landlord must tell the tenant about both protections.
  • The correct route. Immediate termination has stricter conditions than a notice with a three-month period.

The Czech Ministry for Regional Development explains that a landlord’s notice must identify the facts behind the reason and inform the tenant about objections and judicial review. Read the ministry’s current formal requirements for a tenancy notice.

Separate a defective document from a disputed story

A notice can fail at more than one level. Keep the levels separate because they require different evidence and a landlord may try to repair one while leaving another unresolved.

  • Form: was there a written, attributable notice that reached the correct tenant or tenants?
  • Content: does it identify the apartment, the termination route and the concrete facts, and explain objections and court review?
  • Legal fit: can that ground be used for this contract type? Personal or family housing need, for example, is a route for an indefinite tenancy.
  • Truth and seriousness: did the alleged event happen, is it documented, and is it serious enough for the route chosen?
  • Required prior step: for immediate termination under Section 2291, was there a prior demand giving a reasonable chance to remedy the continuing problem?

When may a landlord terminate?

Common statutory routes include a serious breach of the tenant’s obligations, certain intentional criminal conduct, a public-interest reason that makes the apartment unusable, or another comparably serious reason. For an indefinite tenancy, the law also contains limited landlord-or-family housing-need grounds. The exact ground matters: the facts in the notice must match it. If the letter says the landlord, a child or another relative will move in, use the dedicated personal-use notice checks.

Selling the apartment is not, by itself, a reason to terminate a residential tenancy. A new owner generally steps into the landlord’s position. Likewise, “the contract says I can terminate whenever I want” is not a substitute for a statutory reason. A planned refurbishment also needs its own repair, temporary-vacancy or termination analysis rather than a generic demand to leave.

Match the claimed reason to the evidence

  • Rent or service arrears: make a month-by-month ledger and match it to bank statements, receipts, service advances, credits and any disputed increase. Do not use only the landlord’s total.
  • Noise, damage or other conduct: ask which dates, people and incidents are alleged. Preserve prior warnings, witness messages, photos, repair reports and your responses.
  • Unauthorised subletting or use: distinguish a visitor, household member, roommate and subtenant; collect the contract, notifications, consents and proof of how the apartment is actually used.
  • Landlord or family housing need: check that the tenancy is indefinite and that the notice identifies the future occupant and qualifying relationship. Preserve any dated sale or re-rental advertisement without impersonating anyone.
  • Sale or renovation: neither label automatically proves a termination ground. Save the listing, project description and every explanation of why the apartment supposedly must be vacated.

Immediate termination is a separate category

A landlord may use termination without a notice period only for an especially serious breach. Government guidance lists examples such as rent and service arrears for at least three months, serious damage to the apartment, or serious disturbance of other residents. Before using this route, the landlord must normally give a written opportunity to remedy the continuing problem. Missing that prior step can be decisive.

Which delivery date starts the clock?

Use the date the notice legally reached you, not automatically the date printed on it or the day the landlord says it was sent. Personal handover, a registered letter, a data-box message and an electronically signed document can create different evidence and delivery questions. Refusing or failing to collect a document may not prevent delivery. Keep the envelope, tracking record, data-box receipt and complete electronic file, and have any disputed date checked.

Protect two different timelines

For a standard three-month notice, the period generally starts on the first day of the calendar month after delivery. But do not calculate the date from memory: note the delivery method, contract type, and exact wording, then have the dates checked if your housing depends on them.

The three-month notice period and the two-month period for starting court review are not the same clock. Immediate termination creates another route: the tenancy is said to end on delivery and Section 2291 applies stricter ground, content and prior-remedy requirements. Put every candidate date in one chronology rather than writing only “three months.”

A practical response sequence

  • Build one evidence folder: lease and amendments, notice and envelope, payment confirmations, handover report, photos, repair requests, and all landlord communication.
  • Write a chronology: delivery date, alleged events, warnings received, payments, repairs, and conversations.
  • Respond factually: identify what you dispute and ask the landlord to withdraw or clarify the notice. Avoid admissions made simply to calm the situation.
  • Protect the legal deadline: contact a Czech lawyer, legal-aid service, or tenant-advice organisation before the two months expire.
  • Create a housing fallback: if moving is possible even while the dispute is unresolved, define your area, price ceiling, and move-in date and save a rental search.

A first written objection you can adapt

Attach only useful copies and keep proof of sending. Do not speculate, insult, admit a debt you have not reconciled, or sign a separate termination agreement inside the same exchange. Written objections may resolve the matter, but they do not safely replace the Section 2290 court application.

If court review may be needed, prepare the file early

The Ministry states that the application is filed with the district court for the place where the apartment is located (an obvodní court in Prague and the Municipal Court in Brno). A working file should identify the tenant and landlord, the notice and delivery date, the requested review, the decisive facts, and the evidence. Keep the lease and amendments, full notice, delivery proof, chronology, payment ledger and ground-specific evidence together.

Five mistakes that weaken the tenant’s position

  • Stopping all rent or service payments because the notice appears invalid.
  • Signing an “acknowledgement” that is actually an agreement to end the tenancy.
  • Returning keys or signing a handover report before deciding whether to contest the notice.
  • Treating negotiations, objections or a promised withdrawal as an extension of the two-month period.
  • Ignoring a later court document because objections were already sent to the landlord.

Different rules apply when the fixed term is simply not renewed, when the landlord is selling the apartment, or when the conflict concerns serious defects and repairs. Identify the event before applying the deadline. If the landlord later seeks possession after the tenancy has ended, protect the separate deadlines in the 2026 eviction-order process.
