Czech landlord selling in 2026: must you move out?
A sale changes the owner, not automatically the tenancy. Understand what transfers, which viewings you must allow, and what to document before paying anyone new.

Your landlord says the apartment is going on the market and asks when you will leave. Those are two separate events. A change of owner is not, by itself, a statutory reason to terminate a Czech residential tenancy. The practical work is to protect the lease, control access for the sale, and document who receives rent and holds the deposit.
Which message did you actually receive?
- “We are listing the apartment”: no ownership or tenancy change has happened yet.
- “Allow the photographer and every buyer”: separate sale access from statutory inspection, repair and replacement-tenant access.
- “Sign this new lease for the buyer”: the existing residential lease does not need replacement merely because ownership changes.
- “The buyer wants to live here”: that wish is not a same-day eviction; test lease term, statutory ground, notice content and deadlines.
- “Pay this new account from tomorrow”: verify the effective ownership change and instruction before redirecting rent.
- “Leave voluntarily and we will return the deposit”: price and document a surrender agreement rather than treating return of your own security as compensation.
Does the tenancy continue after the sale?
Government guidance states that a change of ownership is not a reason to terminate a residential tenancy. The buyer generally enters the existing landlord’s rights and obligations. Check the exact lease, term, amendments, deposit, service arrangements, and any notice already served; the sale does not erase those facts. If ownership uncertainty began with the owner’s death, use the estate-authority and safe-rent-payment guide before changing accounts.
You do not have to sign a replacement lease just to preserve the tenancy. A sale does not by itself increase rent, shorten a fixed term, erase repairs or restart the deposit. Preserve every amendment and side agreement, however: Section 2221 contains a qualification for former-landlord obligations beyond the statute that the buyer did not know about. Give the new owner a complete, dated copy and proof of any unusual promise.
Can the new owner terminate because they want to move in?
Not merely because they bought the apartment. For an indefinite residential lease, the Civil Code has a separate three-month landlord notice ground for the landlord’s own housing need and a defined spouse/relative branch. That ground does not automatically shorten a fixed-term lease, and the notice must still satisfy the statutory content, reason and review rules. Refusing to sign a new lease or immediate rent increase is not the same as breaching the existing lease. Rent can change only through the existing agreement, a valid indexation mechanism, a new agreement or the statutory rent-increase route described in the rent-increase evidence guide.
Must you allow buyer viewings and photographs?
The Ministry for Regional Development distinguishes sale viewings from viewings for a future tenant. Its tenant guide says a tenant does not have to make the apartment available to prospective buyers or allow an estate agent to photograph it. By contrast, during the final three months before a tenancy ends, the tenant may have to allow pre-announced viewings for prospective replacement tenants.
You can still agree to reasonable buyer viewings. If you do, set written boundaries: proposed time windows, advance notice, who will attend, whether photographs are allowed, which personal items must not be shown, and whether you or your representative will be present.
Must the landlord offer the apartment to you first?
There is no universal tenant priority for every apartment sale. A narrow Civil Code pre-emption right can apply under Section 1187 to the first transfer of a unit created by division into units, subject to its conditions and exceptions. If the home was recently converted into a unit, have the acquisition history checked before assuming either that you have no right or that the owner must always sell to you.
What if the landlord sends a termination notice?
Do not evaluate it as “part of the sale.” Evaluate it as a separate notice: written form and delivery, a specific statutory reason, information about objections and court review, and the correct notice period. Before paying a new owner
- Ask for written confirmation of the ownership change and effective date.
- Verify the new payment account through a trusted, documented channel.
- Request written confirmation of who holds and must return the deposit.
- Record current meters, open repair requests, service advances, and unresolved reconciliations.
- Do not pay the same month twice because two parties gave conflicting instructions.

Udělejte kauci a služby dohledatelné přes den převodu
Od obou vlastníků chtějte jeden podepsaný přechodový přehled: původní jistina kauce, datum platby, dohodnutý základ úroku, doložené srážky, částka předaná kupujícímu a osoba, která ji při skončení nájmu vyúčtuje. Neplaťte druhou kauci ani se nevzdávejte úroku jen proto, že si ji prodávající s kupujícím nevypořádali. Podle § 2254 pronajímatel při skončení nájmu vrací jistotu po započtení dluhů a nájemce má právo na úroky.
Ke dni převodu opište měřidla a sepište zálohy na služby, zúčtovací období, otevřená vyúčtování, přeplatky, nedoplatky a námitky. Rozdělení mezi prodávajícím a kupujícím nemaže práva nájemce podle zákona o službách. Chtějte určit poskytovatele pro každé období a spis k vyúčtování služeb neuzavírejte, dokud nejsou všechna období vypořádána.
Ownership of Czech real estate changes through cadastral registration, not merely because a buyer signed or the agent announced “completion”. Check the official cadastral viewer, ask for the effective date and independently verify any new bank account. If instructions conflict, obtain tailored advice about a safe payment route rather than guessing or withholding rent indefinitely.
Make the deposit and services traceable across the handover
Ask both owners for one signed transition statement recording the original deposit principal, payment date, agreed interest basis, any documented deduction, the amount funded to the buyer and who will account for it when the lease ends. Do not pay a second deposit or sign away interest merely because the seller and buyer failed to settle it between themselves. Under Section 2254, the landlord returns the security at the end of the tenancy after setting off debts and the tenant is entitled to interest.
Record meters on the ownership cut-off date and list every service advance, accounting period, open statement, overpayment, underpayment and objection. A seller–buyer allocation does not erase the tenant’s rights under the Services Act. Ask who remains the service provider for each accounting period and keep the service-statement evidence file open until every period is settled.
If you are willing to leave early
Treat early departure as a negotiation, not an obligation. Put the move date, rent through handover, deposit return, service reconciliation, moving contribution, viewings, condition report, and key transfer into one written agreement. Price the real replacement cost before accepting: new deposit, commission, overlapping rent, movers, and a possible commute change.
- State that the tenancy ends by agreement—not “because of the sale”—on an exact date and only if the agreed conditions are met.
- Separate return of deposit principal and interest from any additional relocation payment.
- Set payment timing, cleared-funds evidence, meter readings, condition report, keys and release language.
- Preserve later service reconciliation and hidden overpayment claims instead of signing a blanket waiver.
- Do not hand over early on an oral promise that the purchase will later fund your move.
