Czech landlord died in 2026: lease, rent and heirs

The owner’s death does not erase your home or payment duty. Preserve the lease, verify estate authority, pay safely and keep repairs, services and deposit evidence alive.

You learn that the owner of your rented apartment has died. A relative sends a new account number, another asks for keys, and nobody knows who will inherit. Do not stop paying, move out or sign a replacement lease merely because of the death. Preserve the existing tenancy while you verify who may manage the estate and receive performance on its behalf.

Death and the end of the lease are different events

Section 1479 says inheritance rights arise on the deceased’s death; the probate decision later confirms who acquired the inheritance and, where relevant, how it was divided. Sections 2221 and 2224 are the tenancy anchor: lease rights and duties follow the ownership succession, and a landlord may not terminate a residential lease merely because ownership changed. The rent, fixed or indefinite term, service rules, repair duties, deposit evidence and lawful termination grounds do not disappear with the original owner.

Do not import Section 2283 from advice about a deceased tenant. Its special two-month termination route addresses a lease that passed to the deceased tenant’s heir after no household succession. It does not give an heir who inherited the landlord’s apartment a general shortcut to remove the living tenant.

Who manages the property before inheritance is confirmed?

Under Section 1677, an appointed estate administrator manages until inheritance is confirmed; otherwise an executor of the will does so. If neither was appointed, the heir manages, and multiple heirs generally manage together unless they agree otherwise. A court can order another measure for a serious reason. Section 1678 limits ordinary estate management, while larger transactions may require consent or court involvement under the following provisions.

The notary acting as court commissioner conducts the probate process but is not automatically the person entitled to collect rent or rewrite the lease. Ask for the appointed notary’s contact and for a document identifying the person who manages this estate and the scope of their authority. “I am the daughter” or “we will inherit” is not a payment instruction by itself.

The probate court is generally the court for the district where the deceased had registered permanent residence—not automatically where the rented apartment lies. The court appoints the notary; relatives and tenants do not choose one. The Notarial Chamber publishes assignment schedules, so ask the likely court or use the current schedule to identify the office. A tenant is not thereby entitled to the whole private probate file; request only the authority and payment information needed for the lease.

Do not stop the rent clock while authority is clarified

  • Read the lease for the due date, account, variable symbol, notices and property manager.
  • Save the last successful payments and the date you learned of the death.
  • Write to the known estate contact asking who administers the lease and how current payments should be identified.
  • Keep each due amount available and do not spend it because nobody answered yet.
  • Do not redirect rent to a private account without written authority and matching identity.

Search summaries often say “never pay the deceased’s old account” and simply hold the money. That is too categorical. An existing bank account, standing order or manager may continue to function, but technical acceptance of a transfer does not answer every dispute about discharge to the correct creditor. Conversely, cancelling every payment automatically can create arrears. Record what you knew on each due date and obtain case-specific advice before changing a proven route.

If the correct creditor is genuinely uncertain, court custody may matter

Section 1953 allows substitute performance into court custody where performance is impossible because the creditor is unknown or absent, refuses without reason, the debtor is without fault uncertain who the creditor is, or another important cause exists on the creditor’s side. This is a legal procedure, not a savings account labelled “rent.” Ask a Czech lawyer which court, proposal, recipient description, evidence, amount and timing are required. A defective deposit or a pile of cash at home may not protect against default.

Verify a new landlord before changing the account

  • Identity of the claimed heir or representative and a reliable service address.
  • Final probate decision or an earlier estate-management authority document appropriate to the requested act.
  • Current cadastral information, understood together with the probate timing rather than used as the only proof.
  • Written continuity statement covering the lease, deposit, payment history, services, repairs and open notices.
  • One coordinated account where several heirs are involved, or authority explaining who may collect for all.

A new landlord can notify you of a legitimate payment account without needing a brand-new lease. Do not sign an amendment that quietly changes the term, rent, deposit, repair duties or termination rights merely to acknowledge the successor. If a property manager remains, ask whether its mandate survived and who now instructs it.

Use the cadastre as a cross-check, not as a complete payment instruction. The deceased may remain displayed while probate is pending, and after a final decision the notary sends inheritance materials for cadastral registration. Ownership also need not be the only source of collection authority: an estate administrator, surviving co-owner, representative or other authorised manager may be relevant.

Repairs, services and privacy continue during probate

Keep reporting urgent defects through the contractual channel and the verified estate contact. Preserve photographs, dates, access proposals and mitigation. Building services, annual reconciliation and direct utilities follow their own contracts and data; do not assume the owner’s death cancels heat, water or the administrator’s obligations.

A relative does not gain an inspection right merely by expecting to inherit. Require identity, authority, purpose, notice and a reasonable time before access, except for a genuine emergency. Apply the landlord-entry evidence checklist to the estate representative as well.

The deposit remains a documented lease obligation

Preserve the original transfer, receipt, contract cap, agreed interest terms and any later top-up. Ownership succession does not make the deposit a voluntary gift to the deceased or permit the tenant to consume it as the next rent. Ask the estate administrator and later owner to confirm how the liability is recorded. At the eventual end, use the deposit return, interest and deduction workflow against the properly identified landlord.

An heir cannot invent a rent increase or termination ground

The existing rent changes only through the same contractual or statutory routes that applied before. A new account is not consent to a higher amount. Test any proposed increase with the Czech rent-increase decision guide. A notice must still meet the residential termination rules; “we inherited and want to sell” is not itself a statutory reason.

If the heirs sell the occupied apartment

First they need the authority and sale route established through probate. A later buyer generally enters the lease position. Separate inheritance, marketing, viewings, ownership transfer and any voluntary move-out agreement. If you want to leave, use an ordinary valid exit

The landlord’s death does not automatically release a tenant who wants to move. Identify whether the lease is fixed or indefinite, choose a valid notice or agreement, serve it on the authorised estate party, and document the apartment handover. If authority or service is disputed, obtain advice before assuming an email to one relative started the notice period. Follow the tenant exit and handover timeline.

Red flags during the transition

  • Several relatives demand the same month’s rent into different personal accounts.
  • Someone refuses to identify the estate, notary or authority but threatens immediate eviction.
  • A “receipt” requires cash with no lease period, apartment or recipient identity.
  • A new lease erases the deposit, shortens the term or adds a fee as the price of staying.
  • Someone seeks keys, photographs or unaccompanied entry before proving authority.
  • The alleged heir says residential ownership change alone cancels the tenancy.

Your continuity file

  • Lease, amendments, handover protocol and deposit evidence.
  • Rent and service ledger with bank confirmations before and after death.
  • Date and source of the death notice and every authority request.
  • Probate/notary contact, estate-manager proof and later final inheritance evidence.
  • Repair notices, service statements, utility contacts, access requests and responses.
  • Every account change, termination, increase or sale communication with delivery evidence.
