Can a Czech landlord enter my apartment without permission?

Landlords may arrange inspections and necessary repair access, but ordinary ownership is not a standing permission to enter, search belongings, or take photographs.

You return home and realise the landlord has been inside, or receive a message announcing an inspection with no discussion. A landlord owns the apartment, but the tenant has the right to use it as a home. Separate a legitimate inspection, necessary repair, or emergency from unrestricted access.

Ordinary inspections require prior arrangement

Section 2219 requires advance notice within a reasonable time and limits access to the necessary extent for inspection, repair, or maintenance. Current MMR guidance says the landlord should agree a specific time and the tenant or an authorised representative may be present.

Offer reasonable alternatives rather than simply refusing every request. Repeatedly blocking a legitimate inspection or necessary repair without a serious reason can itself become a tenancy problem. If the project requires you to empty the flat rather than merely allow entry, use the temporary-vacancy and renovation procedure.

When can the landlord enter without advance notice?

Section 2219 removes the advance-notice requirement where entry is necessary to prevent damage or there is danger in delay. A burst pipe while the tenant cannot be reached is different from a routine cleanliness check. Ask for a written record afterward: reason, time, people present, actions taken, photographs, and any damage. If water has already entered the apartment, switch to the flood response, evidence and insurance checklist.

Keys, searches, and photographs

  • MMR guidance says the landlord is not entitled to retain keys as a general right.
  • The landlord may not search personal belongings.
  • Photographs require consent, apart from limited documentation such as defects or meter readings.
  • Access for a repair does not automatically authorise inspection of unrelated rooms or possessions.
  • Write down any access arrangement, including who may use a key and for which purpose.

Viewings are not all the same

Section 2233 applies during the final three months before a known end date: the tenant allows a prospective next tenant access to the necessary extent, after reasonable advance notice, in the presence of the tenant and landlord. If a long absence also makes the apartment hard to access

Section 2269 applies when you know in advance both that you will be absent for more than two months and that the apartment will be difficult to access. Notify the landlord in time and identify someone who can enable entry when strictly necessary. If no such person is available, the statute assigns that role to the landlord. Record the contact and limits in writing.

When access itself seriously disrupts the home

If inspection, repair, or a final-three-month viewing creates more than insignificant difficulty, Sections 2219(2) and 2233(2) provide a route to a rent reduction. That is fact-specific: document dates, rooms affected, inability to use the home, and the landlord’s activity before proposing an amount or set-off.

How to respond to repeated unauthorised entry

  • Create a dated access log and preserve every message and witness.
  • Ask in writing who entered, when, why, and what was done.
  • State the acceptable notice, contact method, time windows, and emergency process.
  • Offer reasonable access for valid inspections and repairs.
  • Seek individual legal help if entry continues, property is searched, locks are used against you, or retaliation is threatened.
