Czech sublease termination in 2026: notice and rights

A sublease notice is not a shorter landlord notice. Identify the contract route, main-lease event, deadline, court path and money consequences before leaving.

Someone says your sublease is over and you must leave. Do not begin by borrowing the three-month period or two-month court deadline from an ordinary apartment lease. First prove who gave you the right to live there, whether the main lease still exists, and which termination clause the notice actually uses.

First prove that this is really a sublease

  • The owner or an authorised owner representative contracted with you: this may be a lease, even if the document uses loose wording. Switch to the landlord-notice validity and two-month review guide.
  • A tenant contracted with you: this is the usual sublease chain—owner or cooperative → tenant → subtenant.
  • A cooperative member lets you use a cooperative apartment: the arrangement is commonly a sublease because the cooperative member is normally the tenant, not the unit owner.
  • A hotel, dormitory or accommodation provider contracted with you: an accommodation contract may follow a different route again.

The document title alone does not safely classify the relationship. Map the parties and supporting authority with the Czech rental-versus-sublease guide. A wrong classification can send you to the wrong deadline and the wrong type of court claim.

Build the minimum evidence pack

  • Sublease agreement, annexes, house rules and later amendments.
  • Proof of the tenant’s main lease and any landlord or cooperative consent you received.
  • The whole notice, its attachments and proof of when and how it reached you.
  • Month-by-month payments, service advances, deposit receipt and disputed deductions.
  • Handover protocol, inventory, meter readings, photos and key list.
  • Messages about the claimed breach, warnings, repairs, roommates, owner request or ending of the main lease.

Missing owner consent creates two different disputes

If the tenant permanently lives in the apartment and sublets only a part, Section 2274 may allow that without owner consent. If the tenant does not permanently live there, Section 2275 generally requires a written request and consent; no response for one month can count as consent unless the main lease prohibits subletting. Section 2276 treats a prohibited subletting arrangement as a serious breach by the tenant.

Do not collapse that owner–tenant breach into the separate tenant–subtenant account. Missing consent may expose the main lease to termination and then destroy the derivative right, but it does not by itself decide who must repay prepaid rent, return the deposit or answer for a false promise of lawful housing. Preserve the main-lease consent evidence and the sublessor’s representations as two files.

Identify which event supposedly ends your right

  • Agreed fixed end: the date in the sublease arrives without a separate early-termination notice.
  • The main lease ends: the dependent sublease cannot outlive it, even if your own document promised a later date.
  • Notice under a contract clause: the tenant relies on an agreed ground, no-reason route, notice period or immediate-termination clause.
  • Mutual end agreement: this is only an agreement if you knowingly accept it; a proposed signature is not already a unilateral notice.
  • Owner demand or court paper: the owner may assert that the main lease and your derivative right have ended. A court document has its own response instructions and must not be treated as ordinary correspondence.

There is no universal 15-day sublease notice

Search summaries often say that a Czech sublease “commonly” has a 15-day period. Fifteen days may be written into a particular contract, but it is not a universal statutory rule. Start with the duration and termination text the parties actually agreed. Do not import the residential landlord’s protected grounds, a three-month tenant notice, a commercial-space period or a website’s “usual” period without identifying why it governs this contract.

  • Fixed term with no early-exit route: it ordinarily runs to the agreed date unless another contractual or legal ending ground applies or both sides agree.
  • Fixed term with an agreed route: apply only the party, ground, notice period, calculation and form the clause actually provides, subject to mandatory law.
  • Indefinite term with an agreed period: apply the contract after checking validity, interpretation and any consumer issue.
  • Indefinite term genuinely silent: Supreme Court doctrine allows the nearest use-of-a-thing rules to fill gaps; Section 2231’s three-month period for immovable property may therefore be the relevant fallback, not a free-standing rule for every sublease.
  • Main lease ends first: every longer calculation is cut off because Sections 2215(3), 2277 and 2278 prevent the derivative right from outliving the lease.

Also distinguish the length of a notice period from when it begins and on which day it ends. A contract may count from receipt, the following day, the next calendar month or another defined event. Preserve the actual receipt date and calculate each plausible route instead of writing only “one month.”

The sublease contract is the centre of the review

Czech legislation regulates sublease termination much less completely than a protected apartment lease. Read the provisions on duration, termination grounds, which party may use them, form, delivery, notice period, calculation of the end date, immediate termination and what happens if the main lease ends.

The opposite problem is also possible: a sublease may expressly allow a broader or shorter route than an apartment landlord could use against a tenant. Do not assume either that every harsh clause works exactly as written or that tenant-protection rules automatically erase it. Check the clause, surrounding terms, parties and facts together.

If the contracting tenant repeatedly supplies housing as a business and you act outside business, consumer transparency and unfair-term rules may also matter. A one-off private sublessor is not automatically an entrepreneur. Record who marketed the home, who issued invoices, whether standard terms were used and whether the challenged clause was clear and individually negotiated before applying consumer labels.

The main lease is a hard ceiling

Civil Code Sections 2277 and 2278 tie the sublease to the main lease. If the main lease ends, the sublease ends no later than it regardless of a later date agreed between tenant and subtenant. Ask the contracting tenant to identify the main-lease event, delivery date, notice period and final date in writing and to show the relevant proof with unrelated personal details redacted.

Section 2277 expressly requires the tenant to tell the subtenant that the lease is ending and state the decisive facts—especially the end date and, where relevant, the length and start of the notice period. “The owner wants the apartment back” is not that explanation. But missing or defective information does not by itself keep a derivative right alive if the main tenancy genuinely ended. Preserve both questions: whether occupation continues and what performance, repayment or damages claim may exist against the tenant who granted the sublease.

The Supreme Court’s published R 94/2020 rule is strict: the sublease ends with the main lease regardless of why the main lease ended and regardless of a conflicting later sublease date. That does not erase a possible claim against a tenant who promised a longer term, withheld the end event or caused avoidable loss. It means that claim normally cannot manufacture a direct right to stay against the owner after the legal ceiling has disappeared.

Seven checks for the notice itself

  • Sender: is it the contracting tenant, an authorised representative, the owner, the cooperative or a court?
  • Route: fixed expiry, end of main lease, an agreed notice clause, withdrawal from contract or a proposed agreement?
  • Clause: which exact paragraph grants this party the route being used?
  • Facts: what happened, on which dates, and does it fit an agreed ground?
  • Form and delivery: does the contract require writing, a signature, a particular address or a provable delivery method?
  • Period: when does it start, how long is it, and how was the claimed final day calculated?
  • Accounting: what happens to prepaid amounts, services, deposit, keys and damage claims?

The special two-month tenant action does not transfer

This does not mean a subtenant has no rights. It means the procedural path must fit the actual dispute. The notice’s effect may be decided as a preliminary question in an eviction case, or the relevant claim may concern performance, possession, repayment or damages. The Supreme Court also warns that a general declaratory action can fail where the requested declaration does not itself resolve the dispute and no urgent legal interest is shown.

Obtain case-specific Czech advice early, especially if a handover or court date is near. The Czech Bar Association publishes the current official route to legal assistance. Asking for help does not pause a contract or court deadline.

A first written response you can adapt

Add your specific disagreement and attach only useful copies. Keep proof of sending. A response can clarify or resolve the dispute, but it does not neutralise a court paper or create a deadline that the law or contract does not contain.

No notice authorises self-help eviction

A disputed end date is not permission to change locks, remove belongings, cut utilities or use threats. Preserve photos, messages, witnesses and access evidence. If that is already happening, use the lockout and utilities emergency checklist and obtain urgent advice about possession. Call emergency services if there is an immediate threat to safety.

Prepare the money and handover track separately

  • Keep a ledger through every disputed end date instead of using one unexplained balance.
  • Separate rent or use compensation, services, energy, deposit, damage and prepaid amounts.
  • Photograph the entire home, record meters and inventory, and list every returned key.
  • State in the handover record what remains disputed; do not sign a blanket debt acknowledgement or waiver.
  • Request an itemised final accounting and return of the undisputed balance to a stated account.

The handover evidence checklist remains useful, but do not copy every lease-specific deposit rule into a sublease without checking the contractual and legal basis. If the money is already being withheld, use the sublease-deposit recovery steps to identify the debtor and challenge each deduction.

Eight dangerous shortcuts

  • “The title says lease, so I am a tenant.” The actual parties and source of the right classify the chain.
  • “Every sublease has a 15-day period.” No universal statute says that.
  • “Every indefinite sublease automatically has three months.” Section 2231 may fill genuine silence, but the contract and legal context come first.
  • “A fixed-term sublease can always be ended without reason.” Find the agreed or legal early-exit route.
  • “The owner wants it back, so both contracts ended.” Prove a valid main-lease event and calculate its date.
  • “Missing owner consent makes every payment agreement disappear.” It creates main-lease risk but does not settle every tenant–subtenant money claim.
  • “I have two months to file the Section 2290 action.” That special lease review does not extend to a residential sublease.
  • “Returning keys accepts every deduction and notice.” Preserve scope, condition, meters and disputed money expressly.
