Czech property purchase: contract, escrow and cadastre

After reservation, the purchase contract, escrow and cadastral filing must work as one sequence. Check when money moves, who files and what stops release.

Your offer is accepted and the reservation is signed. Now you are being asked to sign several documents and send the largest payment of the transaction. Treat the purchase agreement, escrow agreement and cadastral filing as one control system: no document is safe if the other two leave a gap.

Start with one transaction map

Your transaction may need a different order, especially with an existing seller mortgage or a new buyer mortgage. Write the actual sequence on one page. For every arrow, name the responsible person, deadline, proof and consequence if the step fails.

1. Re-check the property immediately before signing

Open the official Czech cadastral viewerand compare the owner, unit or parcels, shares, title sheet, restrictions and current filing markers with the contracts. Re-check after signing and during the registration process. A clean extract from the viewing date is not proof of the filing state today.

  • Include the unit, relevant land shares, cellar, parking and accessories—not only the street address.
  • List which liens or easements may remain and which must disappear before release.
  • Match the agreed equipment and condition to an annex or handover record.
  • Confirm every owner and any valid authority used to sign for a party.

2. Make the purchase agreement operate the whole sequence

  • Exact property, price, reservation-payment credit and source of each payment.
  • Deadlines for signing, escrow funding, mortgage cooperation and cadastral filing.
  • Who keeps the signed originals and who is authorised to submit them.
  • Required title state for release, including treatment of old and new mortgage liens.
  • Process for a cadastral request, interruption, rejection or withdrawal.
  • Handover date, keys, meter readings, occupancy, risk, defects and retained documents.
  • Termination, cure periods, refunds, documented costs and balanced consequences of default.

Avoid contradictions between the purchase and escrow agreements. If one says the price is released after registration while the other permits a party’s simple written instruction, the weaker release rule can defeat the plan.

3. Verify the escrow before sending money

For advocate escrow, identify the advocate independently, read the current Czech Bar escrow informationand use its safe-escrow checklist. Confirm the designated account and instructions through a trusted channel; do not accept a changed account only because it appears in a familiar email thread.

Under the current Advocacy Actand Czech Bar process, the arrangement must be written, money is held in a special advocate escrow account and the escrow is recorded in the Electronic Escrow Book before funds are accepted. Require the bank and Bar notifications applicable to your role, and independently verify that the account is an escrow account for this transaction. The Czech Bar Guarantee Fund is an additional statutory safeguard with eligibility and payment limits; it is not a promise that every loss or the full purchase price will be reimbursed, and it is distinct from bank-deposit insurance and the advocate’s professional liability cover.

  • The escrow agreement identifies the parties, amount, account and origin of funds.
  • You receive the confirmations and notifications required for that escrow type.
  • Release depends on objective documents and cadastral state, not vague consent.
  • Return conditions cover failed funding, rejected registration, termination and long-stop dates.
  • No permitted deduction, fee or partial release is left undefined.

4. Control the cadastral filing

The official ČÚZK registration guidancecurrently states a CZK 2,000 administrative fee for each proposal. The official filing applicationcan prepare the form and supports eligible online filing with a 20% fee discount. Electronic filing has document and signature requirements, so do not assume that a scan of a paper contract is enough.

After the cadastral office informs affected persons, it cannot permit the registration before the statutory 20-day protection period expires. That is a minimum safeguard, not a promised completion date. ČÚZK reported an average registration time of 22 days in June 2026; individual cases can take longer.

  • Agree who files and require proof of filing and the proceeding reference without delay.
  • Check that the proposal and signed deed name the rights, parties and property consistently.
  • Monitor the filing marker and proceeding; do not treat silence as approval.
  • Before release, obtain the evidence specified in escrow and check for unexpected later filings.

If the office has already rejected the ownership filing, switch immediately to the rejected-vklad 30-day, escrow and priority workflowbefore anyone refiles, releases money or treats the transaction as failed.

5. If a mortgage is involved, draw both lien paths

A financed purchase can involve the seller’s existing bank, the buyer’s new bank, payoff confirmation, a new lien filing and later deletion of the old lien. Record the required filing order, bank drawdown conditions, payoff amount and deadline, permitted temporary title state and evidence needed before each portion of the price is released.

If financing is not yet secure, revisit the reservation-agreement conditionsand the response plan for a mortgage rejected after reservationbefore signing unconditional payment deadlines.

6. A cadastral problem is a stop signal, not a reason to improvise

If the office asks for clarification, interrupts the proceeding or signals rejection, preserve the notice and every deadline. Do not let one party withdraw, replace a deed or authorise release outside the agreed process without checking the legal and escrow consequences. The agreement should say who remedies a correctable problem and when money must return if the transfer fails.

If the seller refuses before or after signing, use the seller-withdrawal contract-stage checklistbefore accepting a verbal cancellation, releasing the reservation fee or abandoning a filing route.

7. Keep handover separate from ownership and payment

Registration, price release and physical handover are different events. State which one triggers keys, access, risk, insurance, utilities, service advances and occupation. At handover, record condition, photographs, meter values, keys, documents, equipment and unresolved defects in a signed protocol.

If a problem appears only after handover, use the hidden-defect evidence and notice plan before an irreversible repair removes the proof. Once title is registered, add the Czech property-tax filing and payment calendar to the closing file.
