Mortgage rejected after a Czech reservation? What now
A rejected loan does not answer who keeps the reservation fee. Freeze the timeline, identify what you signed and why financing failed, then act from the actual clauses.

You reserved an apartment or house, paid a substantial fee, and the bank has now refused the mortgage—or valued the property below the purchase price. The urgent question is not simply “Can I withdraw?” It is: what contracts exist, who promised what, what triggered the fee, and does the financing clause cover the reason the deal failed?
A rejected mortgage does not automatically decide the fee
Czech search results often give a yes-or-no answer, but reservation documents vary. The payment may be described as a reservation fee, an advance on commission, part of the purchase price, a deposit, or a sum connected to a contractual penalty. The agreement may involve the buyer and agency, or the buyer, seller, and agency. Those differences can change who holds the money and the legal basis asserted for keeping it.
Read five things before making a demand
- Parties: who signed and who received the money?
- Purpose: what does the document call the payment and when is it earned or returned?
- Financing condition: does it cover rejection, insufficient amount, or a low property valuation?
- Proof: must you apply to a named bank, several banks, by a deadline, or provide a formal rejection?
- Exit and penalty clauses: what notice, cure period, extension, withdrawal, forfeiture, or set-off language applies?
Also inspect the linked brokerage agreement, draft purchase agreement, general terms and any documents incorporated by reference. Czech law says that where serious doubt exists over whether a prospective client really received referenced documents, the real estate intermediary must prove it.
Check the broker’s statutory handover as a separate branch. Sections 11 and 12 require, among other things, a public-register extract no more than three working days old and information about relevant defects, restrictions, and third-party commission. Missing disclosures may create withdrawal rights from the brokerage agreement, but do not automatically answer a separate seller–buyer promise or the financing condition.
Why did financing fail?
Separate a problem with your income or credit record from a problem with the property, title, seller cooperation, or valuation. A clause covering “failure to obtain financing despite timely cooperation” may be interpreted differently from one that only names a formal mortgage rejection. A low valuation can leave the mortgage approved but the cash contribution unaffordable—so the wording should address both approval and minimum amount.
Your three realistic paths
- Use the financing condition: send the required proof and refund request exactly as the agreement prescribes.
- Extend and repair financing: only if another bank, added collateral, a lower price, or extra equity is genuinely workable.
- Dispute retention of the fee: if the clause does not resolve it, analyse the payment, consumer status, statutory duties and case law before a formal demand.
An extension can preserve the purchase, but it can also extend your exposure or add a new waiver. Put the new deadline, refund conditions, seller’s cooperation with valuation and mortgage security, and treatment of the existing fee into one written addendum.
Consumer protection can matter—but it is not a universal refund rule
Section 14 of the Czech Real Estate Mediation Act says a brokerage agreement cannot require a consumer to conclude the property contract or a future property contract. The Czech Supreme Court applied that protection to a three-party document that was, in substance, a brokerage agreement and rejected a contractual penalty for the consumer’s failure to buy. That does not mean every document titled “reservation agreement” produces the same result; classification and exact obligations still matter.
What should a safer financing clause cover before you reserve?
- The minimum loan amount and latest approval date.
- Rejection due to creditworthiness and inadequate property valuation.
- Which applications and evidence are reasonably required.
- Seller access and cooperation for valuation and mortgage security.
- The refund amount, payer, recipient, deadline, and any permitted deduction.
- What happens if title, defects, documents, or due diligence reveal a material problem.
Mortgage pre-approval is useful but is not final approval of this buyer, property, price and security structure. Before paying, inspect a current cadastral extract and the property itself. If the other side refuses to return the payment
Ask for the exact clause and legal reason for retention, an itemised calculation, and confirmation of who now holds the money. Preserve the demand and response. Because the amount is often significant and the interplay between seller, agency, brokerage agreement and reservation document is fact-sensitive, obtain a Czech lawyer’s review before the limitation period or a contractual deadline becomes an additional dispute.
