Czech accommodation contract vs lease: 2026 rights
A document labelled accommodation can mean weaker housing protection—but the label, address or length alone does not classify it. Test the purpose, setting, services and control.

You live there every day, pay monthly and keep all your belongings there, but the paper says “accommodation contract.” Do not assume the heading erases tenant protection—and do not assume a long stay automatically converts the agreement into an apartment lease. The legal route depends on what the parties agreed, the purpose of the stay and how the space is actually operated.
Start with the situation that brought you here
- A serviced apartment is your only home for months: preserve the advert, repeated renewals, actual services, provider access and what both sides knew about your housing need.
- A dormitory or student residence covers one semester: a defined study purpose and operating services may support accommodation; being a student or staying several months does not decide alone.
- A room is tied to a work assignment: separate the employer, provider, payment, end of work and end of occupancy; staff housing can also involve special lease rules.
- A hotel, hostel or booking-platform stay is genuinely short: focus on the booked purpose, service defects, cancellation and the agreed end rather than residential-lease notice rules.
- A municipality or nonprofit calls the arrangement accommodation: identify any social-service or programme rules as well as the Civil Code contract.
- An “atelier” or non-residential unit is offered as an ordinary home: analyse the private housing agreement separately from lawful and safe building use.
- The provider wants you out or keeps the deposit: classify first, but preserve every deadline and pursue possession and money as separate problems.
Start with the three possible relationships
- Residential lease: a landlord grants a tenant a home to meet the tenant’s or household’s housing needs under Sections 2235–2301.
- Accommodation: a provider supplies temporary accommodation for an agreed period or purpose in a facility intended for accommodation under Sections 2326–2331.
- Sublease: a tenant, not the owner, grants a derivative right that cannot outlive the main lease.

The agreed purpose is the centre of the classification
The Ministry for Regional Development explains that protected residential leasing applies where the purpose is to meet the housing needs of the tenant or household. A recreational stay, hotel, hostel or other temporary accommodation follows a different and generally weaker framework. Ask what both parties understood when the agreement was made—not only how the provider describes it after a dispute begins.
- Home indicators: indefinite or repeatedly renewed occupation, exclusive control, ordinary household life, own utilities, furniture and mail, and no other home expected by the parties.
- Temporary-purpose indicators: tourism, treatment, work assignment, course or semester; a stated external event defines the stay and the parties expect another home elsewhere.
- Accommodation-operation indicators: reception, regular cleaning or linen, room reassignment, shared facilities, guest registration and an operating accommodation establishment.
- Lease-operation indicators: a specific self-contained home is handed over for independent household use and the provider does not run day-to-day accommodation services.
None of these facts should be used as a one-item shortcut. A student can have genuine accommodation for a school year; a short fixed term can still be a residential lease; and an accommodation provider can supply a room that is the person’s practical home for years.
The title, duration and address do not decide alone
In Supreme Court case 7 Tdo 1170/2022, a room in an accommodation facility had supported long-term housing for more than three years, yet the Court worked with the concluded accommodation agreement and its fixed end. The decision was a criminal case about unauthorised occupation, not a universal civil classification test. Its practical warning is narrower: long use or the word “apartment” alone does not prove that protected lease rules replace the agreed accommodation route.
A non-residential label is a different question
Civil Code Section 2236 says that if the parties agree to let a space other than residential premises for habitation, they are bound as if residential premises had been let. A provider therefore cannot answer every issue merely by saying “the cadastre calls it an atelier” or “it was not approved as a flat.” Building-law suitability, safety and permitted use still matter, but they are not identical to the private-law contract classification.
Do not confuse this rule with accommodation. First ask whether the parties agreed on a residential lease of an atypical space, or on temporary accommodation as a different contract. Then separately verify whether the premises can lawfully and safely be used as promised.
What changes if it is a protected residential lease?
- The landlord cannot contract out of tenant-protective rules to the tenant’s detriment.
- Landlord termination needs a statutory route, proper form and applicable review instructions.
- Household members, visitors, pets, entry, repairs, rent, services and deposit follow residential-lease rules.
- A landlord cannot turn a normal home into revocable hotel occupancy merely by changing headings and vocabulary.

What changes if it is genuine accommodation?
Sections 2326–2331 and the agreement carry much more weight. The provider must hand over space fit for proper use and ensure undisturbed exercise of the accommodated person’s rights. The guest uses the space and common facilities under the agreement and reasonable operating rules and pays the accommodation price and services as agreed.
- The special residential-landlord termination grounds and Section 2290 review do not automatically apply.
- The agreed duration or purpose may bring the right to an end without the lease process.
- An accommodated person may terminate before the agreed period, but avoidable loss to the provider can matter.
- The provider may terminate without notice for gross breach of contractual or good-conduct duties after warning, under the statutory accommodation rule.
- Deposit, visitors, animals, room access, services and operating rules depend heavily on the contract and general limits.
“We can remove you today because this is a hotel contract” is still not a complete legal analysis. Check whether the agreement ended, whether the stated ground and warning exist, and which possession process is available. A private document is not permission to threaten, remove belongings, cut utilities or use force.
Deposit rules depend on the classification
If this is a residential lease, Section 2254’s combined three-month ceiling for deposit and contractual penalties and the tenant’s statutory interest right matter. Those lease rules do not automatically copy into genuine accommodation. The accommodation contract should therefore state the amount, holder, permitted deductions, evidence, interest, final accounting and repayment date instead of using only the word “deposit.”
That does not make any deduction valid. Demand an itemised ledger, the clause relied on, photographs, invoices or a repair calculation, and proof of the recipient. Keep ordinary wear, unpaid price, services, missing items and damage as separate rows. Do not sign a handover statement saying there are no further claims unless it truly settles the money.
A professional provider still faces consumer rules
If a business supplies accommodation to you outside your trade, the relationship can also be a consumer contract. Terms and operating rules must have been made genuinely available before contracting; a later web link or rule handed over after payment may not become part of the bargain. Unclear or abusive standard terms can be reviewed under the consumer provisions even though the agreement is not a residential lease.
- Identify the exact legal entity, registration number, contracting site and payment recipient.
- Save the pre-contract price, services, cancellation, deposit and house rules—not only the current webpage.
- Complain in writing about a missing or defective service and state the remedy requested.
- If direct resolution fails, check whether the Czech Trade Inspection Authority’s consumer ADR route covers the dispute; ADR does not itself issue a binding judgment.
Compare the disputed clause line by line
- End date: fixed calendar date, purpose event, notice, immediate termination or renewal?
- Reason: no-reason contractual route, unpaid price, conduct breach, end of assignment or a landlord ground copied from lease law?
- Warning: was one required by the contract or Section 2331, and what exactly did it identify?
- Delivery: who sent the document, under which clause, when did it arrive and how is the final day calculated?
- Money: accommodation price or rent, services, deposit, damage, prepaid amounts and final accounting?
- Possession: key return, belongings, access, handover record and any threatened lock change?
Do not let registration myths decide the contract
Permanent residence is an address record, not proof that a protected lease exists. Conversely, a valid accommodation contract can be evidence of an authorised right to use an address for registration purposes. Use the permanent-residence document and move-out guide for the administrative route, but keep it separate from the civil classification and termination dispute.
The same separation applies to other administrative systems. Current state social assistance can recognise an accommodation agreement as a legal title for its housing component when the statutory conditions are met. For foreign nationals, the provider’s reporting duty uses a broad concept covering accommodation, lease, sublease and similar agreements. Benefit acceptance or police reporting therefore does not prove that the civil relationship is a protected apartment lease.
A written classification request you can adapt
Add the strongest facts and preserve proof of sending. A classification request does not pause a contractual, statutory or court deadline. If a court document has arrived, follow its response instructions and obtain advice immediately.
If access is threatened or already blocked
Preserve messages, access attempts, photographs, witnesses, the inventory and every item left inside. Before signing an accommodation form for an ordinary home
- Ask why a residential lease is not being offered and obtain the answer in writing.
- Identify the genuinely temporary purpose and event that will end it.
- Verify the provider’s ownership or authority and the premises’ permitted and safe use.
- Compare price, services, deposit, access, guests, pets, repairs, liability and handover.
- Read every termination, warning, room-change and belongings clause.
- Do not pay until the final document, rules, price list and refund terms form one consistent package.
